Child Support Guidelines in Shared Custody Situations
For years, divorce lawyers and family court judges have struggled with how to apply the Child Support Guidelines in shared custody situations. Finally, as of June 1, 2015, the Child Support Guidelines provide an answer. “The presumptive current support order shall equal the presumptive current support amount of the parent with the higher net weekly income, payable to the parent with the lower net weekly income.” The analysis doesn’t necessarily stop here, but at least the starting point is now clear.
